VRNs (04.01.2013) – Sài Gòn – Sáng nay, tại Sài Gòn, blogger Nguyễn Hoàng Vi, sau khi được luật sư tư vấn, đã gởi đơn tố cáo “lực lượng an ninh TPHCM, đội an ninh Q1 và công an P. Nguyễn Cư Trinh – Q1 đã có những hành vi vi phạm Hiến pháp và pháp luật nước CHXHCN Việt Nam” đến các cơ quan chức năng của Sài Gòn và Quốc hội.
Trong đơn tố cáo, Hoàng Vi tường thuật lại những việc làm vi phạm pháp luật của ngành công an, hôm 28.12.2012, ngày xét xử phúc thẩm 3 bloggers Sài Gòn.
Vì những hành vi vi phạm pháp luật đó, Hoàng Vi yêu cầu: “Quý cơ quan chức năng có thẩm quyền nghiêm trị những hành vi vi phạm Hiến pháp và pháp luật nước CNXHCN Việt Nam của những tổ chức và cá nhân liên quan đến vụ việc trên” và những biện pháp cụ thể khác.
Nhất là Hoàng Vi kêu gọi mọi người giúp đỡ, để không một phụ nữ nào bị xúc phạm nhân phẩm như vậy nữa. Hoàng Vi viết: “Tôi kêu gọi tất cả những cá nhân và tổ chức cùng quan tâm, giúp đỡ và lên tiếng bảo vệ cho trường hợp của tôi, để những hành vi tương tự sẽ không tiếp tục tái diễn đối với những công dân khác”.

Tôi trình bày sự việc như sau:
1. Khoảng hơn 8h sáng ngày 28/12/2012, khi tôi ngồi chơi ở công viên Bách Tùng Diệp đối diện Tòa án Nhân dân TPHCM thì vô cớ bị rất đông công an mặc sắc phục, trật tự đô thị và những người mặc thường phục đòi kiểm tra giấy tờ. Sau đó những người này bắt tôi về đồn Công an P. Nguyễn Cư Trinh – Q1.
2. Trên xe và trong đồn công an, những người an ninh mặc thường phục đã cướp mất 2 cái điện thoại và toàn bộ giấy tờ tùy thân, tiền bạc của tôi và họ đánh đập tôi rất dã man.
Sau khi đánh tôi, họ bỏ ra ngoài hội ý gì đó với nhau. Khi quay lại, một chị an ninh mặc thường phục bắt tôi phải cởi hết quần áo để khám xét người mà không hề có bất cứ một lệnh nào hết. Tôi không đồng ý, chị ta và một vài người nữa cưỡng chế lột hết quần áo tôi ra (chỉ chừa lại đồ lót) trong sự chứng kiến của các anh an ninh mặc thường phục khác. Và điều ngạc nhiên là họ ngang nhiên quay phim lại cảnh lột đồ và cảnh tôi chỉ còn bộ đồ lót trên người rất lâu.
Quay phim chán chê, họ lại bỏ ra ngoài hội ý tiếp với nhau. Tình trạng sức khỏe lúc đó của tôi không được tốt: vừa đau, vừa mệt, vừa đuối sức, cơ thể tôi bắt đầu trở nên lạnh run và nôn mửa liên tục, họ không thèm quan tâm.
Sau một lúc hội ý với nhau, họ trở vào bắt tôi phải lột hết đồ lót để tiếp tục khám người. Tôi vẫn không đồng ý. Họ cho 4 người cưỡng chế thô bạo, khiêng tôi đặt nằm lên bàn làm việc trong phòng làm việc, lột hết những mảnh vải cuối cùng còn sót lại trên người tôi. Sau đó, họ – gồm 4 người phụ nữ – người nắm tay, nắm chân kéo 2 tay 2 chân tôi dang ra, rồi dùng tay chọc vào chỗ kín của tôi trước sự chứng kiến của các nam an ninh khác khiến tôi rất đau đớn về thể xác lẫn tinh thần. Tôi chỉ biết đau đớn thét lớn, nhưng những người còn lại không có bất cứ phản ứng gì.
Xong mọi việc, những người an ninh mặc thường phục tự làm giấy tờ, biên bản gì đó với nhau mà không cho tôi biết nội dung. Trong lúc đó, cô bé an ninh Q1 đã nói với những người khác là: “Chú Hải bảo làm như vậy”. Tôi sực nhớ có lần những người bạn của chị Tạ Phong Tần từng kể cho tôi nghe về những việc làm sai trái của tên Lê Minh Hải, trong đó có việc làm nhục chị Tạ Phong Tần như đã làm với tôi.
Khoảng hơn 12h trưa, họ đưa tôi về công an P. Phú Thạnh – Q. Tân Phú và tiếp tục giam giữ tôi tại đó đến gần 19h mới cho ra về.
Qua sự việc trên, tôi tố cáo lực lượng an ninh TPHCM, đội an ninh Q1 và công an P. Nguyễn Cư Trinh – Q1 đã có những hành vi vi phạm Hiến pháp và pháp luật nước CHXHCN Việt Nam:
- Bắt cóc và giam giữ tùy tiện trái pháp luật đối với tôi từ hơn 9h30 sáng đến gần 19h cùng ngày 28/12/2012.
- Đánh đập, tra tấn, xâm phạm và xúc phạm một cách nghiêm trọng đến quyền bất khả xâm phạm thân thể, danh dự và nhân phẩm của tôi.
Vì vậy, tôi đề nghị:
- Quý cơ quan chức năng có thẩm quyền nghiêm trị những hành vi vi phạm Hiến pháp và pháp luật nước CNXHCN Việt Nam của những tổ chức và cá nhân liên quan đến vụ việc trên.
- Đại diện của các cơ quan, tổ chức có liên quan phải công khai xin lỗi và bồi thường những thiệt hại, tổn thương về sức khỏe, tinh thần, danh dự và nhân phẩm của tôi.
- Lực lượng an ninh, công an, dân phòng, trật tự đô thị, thanh niên xung phong,… phải chấm dứt tình trạng bắt giữ tùy tiện, tra tấn và dùng nhục hình đối với công dân.
- Tôi kêu gọi tất cả những cá nhân và tổ chức cùng quan tâm, giúp đỡ và lên tiếng bảo vệ cho trường hợp của tôi, để những hành vi tương tự sẽ không tiếp tục tái diễn đối với những công dân khác.

La blogueuse Hoang-Vi Nguyen appelle "toutes les personnes et organisations concernées"
Le 4 Janvier 2013, la blogueuse Hoang-Vi Nguyen, après avoir discuté avec des avocats, a adressé un document accusant “les forces de sécurité de Ho Chi Minh-Ville, 1er Arrondissement et la police du Quartier Nguyen Trinh Cu – 1er Arrondissement d’avoir violé la Constitution et les lois de la République socialiste du Vietnam” aux autorités de Ho Chi Minh Ville et à la délégation du Congrès.
Dans ce document, Mme Hoang-Vi Nguyen rapportait les faits de violation des lois perpétrés par les forces de police le 28 Décembre 2012, soit le jour de l'audience en appel de trois membres du Club des journalistes indépendants.
Pour leur violation des lois, Mme Nguyen suggère : “aux organes ayant autorités et juridictions à sévèrement réprimander les personnes et l’organisation responsables de l’incident ayant entraîné la violation de la Constitution et les lois de la République socialiste du Vietnam.” Surtout, elle appelle "toutes les personnes et organisations concernées à lui venir en aide et à prendre la parole en son nom dans cette affaire, afin qu’aucun autre citoyen ne puisse à nouveau subir de tels agissements."

Je souhaiterais exposer mon cas ci-après :
1. Peu après 8h00 du matin, le 28.12.2012, alors que j'étais assise et me reposais dans le parc de Bach Tung Diep qui se trouve juste en face du Tribunal populaire de Ho Chi Minh Ville, plusieurs policiers en uniforme, des agents de sécurité et des personnes en civil ont demandé à vérifier mes papiers. Ils m'ont ensuite emmenée au poste de police de Nguyen Cu Trinh Cu Ward, dans le 1er arrondissement.
2. Dans leur voiture de patrouille et au poste de police, les policiers en civil m’ont pris mes 2 téléphones, tous mes papiers d'identité, ainsi que tout mon argent. Ils m'ont ensuite battue sauvagement.
Après m’avoir battue, ils m'ont laissée dans une pièce pour discuter entre eux. Quand ils sont revenus, une femme policier en civil m'a ordonné alors qu’elle n’avait pas de mandat de me déshabiller pour une fouille au corps complète.
Ne voulant pas obéir, elle et d'autres personnes m'ont basculée pour retirer mes vêtements (à part mes sous-vêtements), tandis que d'autres agents de sexe masculin observaient.
Curieusement, ils ont filmé pendant un assez long moment pendant que je me faisais enlever mes vêtements.
Ils m'ont ensuite laissée là pour encore parler entre eux. Je n’étais vraiment pas en bon état. J’avais mal, j’étais fatiguée, liquéfiée.
J’avais froid et avais des frissons. J’ai commencé à vomir en continu sans que personne ne me prête attention.
Après avoir discuté, ils sont revenus et m’ont demandé de retirer mes vêtements pour une autre fouille corporelle. J'ai encore refusé d'obtempérer. Quatre policiers m’ont alors forcé à m'allonger sur un bureau, m’enlevant les vêtements qu’il me restait. Elles – les quatre femmes policiers – m’ont tenu les bras et les jambes pour fouiller mon intimité pendant que les policiers masculins qui avaient causé ma souffrance, aussi bien physique que mentale, observaient la scène. Dans ma douleur et ma souffrance, je ne pouvais que crier au-secours, mais ces gens n'ont montré aucune réaction.
A la fin, les policiers en civil ont enregistré une sorte de rapport sans m’informer du contenu. Pendant ce temps, une jeune femme policier du 1er Arrondissement a dit aux autres “M. Hai nous a dit de le faire”.
Je me suis soudain rappelé d’un incident qui m’avaient été rapporté par les amis de Mme Ta Phong Tan s’agissant des agissements de Lê Minh Hai, notamment comment il avait humilié Ta Phong Tan, tout comme ce qu'ils m’ont fait.
Un peu après 12 heures, ils m'ont emmené dans un autre commissariat du quartier de Phu Thanh – dans l’arrondissement de Tan Phu et m’ont gardée jusqu'à presque 19 heures quand ils m'ont relâchée.
S’agissant des incidents ci-dessus, j’accuse les forces de sécurité de Ho Chi Minh-Ville, 1er Arrondissement et la police du quartier de Nguyen Trinh Cu– 1er Arrondissement d’avoir violé la Constitution et les lois de la République socialiste du Vietnam comme suit :
- Ils m’ont enlevé et détenue arbitrairement de 9h30 à 19h00, le 28 décembre 2012
- Ils m’ont frappée, torturée et violé mon droit à l'inviolabilité de mon corps, de mon honneur et de ma dignité
Par conséquent, je suggère :
- aux organes ayant autorités et juridictions à sévèrement réprimander les personnes et l’organisation responsables de l’incident ayant entraîné la violation de la Constitution et les lois de la République socialiste du Vietnam.
- aux représentants des organismes et organisations responsables d'émettre des excuses publiques et de me dédommager pour les dégâts et dommages causés sur ma santé, mon esprit, mon honneur et ma dignité.
- aux forces de sécurité publique, à la police, la défense civile, à l'ordre urbain, et aux jeunes volontaires de cesser les arrestations arbitraires, la torture et l'utilisation des châtiments corporels sur les citoyens.
- Je demande à toutes les personnes et organisations concernées à me venir en aide et à prendre la parole en mon nom dans cette affaire, afin qu’aucun autre citoyen ne puisse à nouveau subir de tels agissements.

Blogger Hoang-Vi Nguyen denounces the security forces of Ho Chi Minh City
VRNs (January, 5, 2013) – Sài Gòn – On January 4th 2013, blogger Hoang-Vi Nguyen, after discussing to lawyers, sent a document to denounce “the security forces of Ho Chi Minh City, Dist. 1 and the police of Nguyen Cu Trinh Ward – Dist. No 1 of violating the Constitution and the Laws of the Socialist Republic of Vietnam” to the authorities of HCM City and the Congressional delegation.
In the document, Ms Hoang-Vi Nguyen reported violating acts of the Laws of the polices on December 28, 2012 which was the day of the Appeal Hearing for three members of the Freelance Journalist Club.
For their violating the Laws Ms. Nguyen suggested: “Agencies with authorities and jurisdiction to severely reprimand the act which violated the Constitution and the Laws of the Socialist Republic of Vietnam of responsible individuals and organization in the incident.” Especially, she called upon “all concerned individuals and organizations to look out for, help and speak out to defend me in this case in order for the similar behaviours not to happen again to other citizens.”

I would like to present my case as follows:
1. Shortly after 8 am on 12/28/2012 when I was sitting to relax at Bach Tung Diep park directly facing the People’s Court HCM City, many uniformed police, urban order personnel and numerous plain-clothes people demanded to have my identifications checked. They later took me to the police station at Nguyen Cu Trinh Ward, 1st district.
2. In their squad car and at the station, the plain-clothes policemen robbed my 2 phones and all my identification documents, as well as my cash. They then beat me up savagely.
After beating me, they left me in a room to confer with one another. When they returned, a plain-clothes security female without a warrant ordered me to take off my clothes for a thourough body search.
Since I would not comply, she and others forced me down to strip off my clothes (except my underwear) while other male officers observing.
Surprisingly enough, they videotaped my ordeal of being stripped off with only my underwear on for quite a long time.
They then left me there to confer with one another again. My physical being was not so good. I was in pain, fatigue, drained.
My body became cold and shivering and I started to vomit continuously while no one showed any regard.
After conferring, they returned to order my clothes off for another body search. I still refused to comply. Four officers then coerced me by force me to lie down on an office table, stripping what’s left on my body. They- the female foursome- then held down my arms and legs to search my private part while being observed by male security officers who caused me to be in so much pain, both physically and mentally. In my pain and suffering I could only scream out for help but these people showed no reaction.
After it was all done, the plain-clothes security officers filed some sort of report without informing me of its content. Meanwhile, a young female security officer from Dist. 1 told others “Mr. Hai told us to do so”.
I suddenly recalled an incident in which Ms Ta Phong Tan’s friends told me about Le Minh Hai’s wrong doings, up to and including humiliating Ta Phong Tan just like what they did to me.
At little pass 12 pm, they brought me to another station in Phu Thanh ward – Tan Phu dist. and detained me there until almost 7 pm when they released me.
Having mentioned the above incidents, I denounce the security forces of Ho Chi Minh City, Dist. 1 and the police of Nguyen Cu Trinh Ward – Dist. No 1 of violating the Constitution and the Laws of the Socialist Republic of Vietnam as follow:
- Kidnapped and arbitrarily detained me from after 9:30 am until almost 7 pm on Dec 28, 2012
- Beat, tortured, and violated the right to inviolability of my body, my honour and my dignity
Therefore, I suggest:
- Agencies with authorities and jurisdiction to severely reprimand the act which violated the Constitution and the Laws of the Socialist Republic of Vietnam of responsible individuals and organization in the incident.
- Representative of the responsible agencies, organizations to issue public apology and compensate me for the damage and harm done on my health, spirit, honour and my dignity.
- Forces of public securities, police, civil defence, urban order, and youth volunteers to stop arbitrary arrests, torture and the use of corporal punishment on citizens.
- I call upon all concerned individuals and organizations to look out for, help and speak out to defend me in this case in order for the similar behaviours not to happen again to other citizens.
